California Proposition 65 Statement
Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, was enacted as a ballot initiative in November 1986. The proposition protects the state’s drinking water sources from being contaminated with chemicals known to cause cancer, birth defects or other reproductive harm, and requires businesses to inform Californians about exposures to such chemicals.

Proposition 65 requires the state to maintain and update a list of chemicals known to the state to cause cancer or reproductive toxicity.This list is much more extensive than the 10 substances regulated by RoHS. It is quite likely that some Prop 65 substances exist in products that fully comply with the RoHS directives. Furthermore, RoHS regulates the concentration of 10 substances but does not attempt to regulate exposure levels of these 10 substances. In general, lower concentrations will result in lower exposure levels. RoHS minimizes exposure by reducing these 10 substances to very low levels. In contrast, Prop 65 sets exposure limits for how much of these and other toxins will be absorbed, ingested, or inhaled when the product is used. Unfortunately, actual exposure is a function of how the product is used, misused and disposed.
Due to the large number of components in electronic devices and the fact that these are supplied from many different manufacturers, we must assume that one or more components contain levels of Prop 65 substances that the State of California deems harmful even though these components meet requirements of the RoHS directives.
